1. Overview

Welcome to Variable, operated by VARIABLE, a Canadian corporation (“Variable,” “we,” “us,” “our”).

By accessing or using tryvariable.com, APIs, or related services (the “Services”), you agree to these Terms.

If you do not agree, do not use the Services.

You must be at least 18 years old.

2. What Variable Is (and Is Not)

Variable provides tools for modeling demand, willingness to pay, and related constructs.

Important:

  • Outputs are exploratory and directional only
  • Outputs are not a source of truth
  • Outputs should not be relied upon as the sole basis for decisions

Generated outputs:

  • May resemble real-world individuals or segments
  • Are not representations of actual persons

You are responsible for how you interpret and use outputs.

3. Accounts & Access

You may be required to create an account.

You agree to:

  • Provide accurate information
  • Keep credentials secure
  • Notify us of unauthorized access

We may:

  • Issue API keys
  • Limit usage
  • Suspend or terminate access at our discretion

4. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes
  • Attempt to reverse engineer or disrupt the system
  • Use outputs to build competing products or models
  • Resell raw outputs without permission

You may use outputs commercially, subject to these Terms.

5. Data You Provide

You may submit:

  • Survey responses
  • Willingness-to-pay inputs
  • Segmentation data
  • Uploaded datasets (CSV, SAV, XLSX, Parquet)

You are solely responsible for:

  • Ensuring you have the right to upload and use this data
  • Ensuring compliance with applicable laws

Critical restriction:

You agree not to upload personal identifiable information (PII) into datasets such as SAV or Parquet files.

6. Generated Data

Variable may generate:

  • Synthetic personas (twins)
  • Demand models
  • Segmentation outputs
  • Utility functions and derived insights

These outputs:

  • Are probabilistic and model-based
  • May be incomplete or incorrect
  • Should be treated as exploratory tools

7. Data Use by Variable

You grant Variable the right to use:

  • Inputs
  • Generated outputs

For the purpose of:

  • Improving models
  • Developing features
  • Creating aggregated insights

We will use such data only in aggregated or non-identifiable form.

8. API Usage

If you use the API:

  • You must use issued API keys
  • You must not abuse rate limits
  • You must not attempt to extract or replicate underlying models

We may suspend or revoke API access at any time.

9. Payments

Payments are processed via Stripe.

Pricing may vary.

Refunds:

  • Provided on a case-by-case basis at our discretion

10. Intellectual Property

All rights in the Services remain with Variable.

You retain rights to your inputs.

You may use outputs commercially, but may not:

  • Resell raw outputs
  • Use outputs to train competing systems

11. Termination

We may suspend or terminate access at any time, with or without notice.

You may stop using the Services at any time.

12. Disclaimers

The Services are provided “as is.”

We make no warranties regarding:

  • Accuracy
  • Completeness
  • Fitness for a particular purpose

No system is completely secure.

13. Limitation of Liability

To the maximum extent permitted by law:

Variable is not liable for:

  • Business decisions made using the Services
  • Loss of revenue, profits, or data
  • Indirect or consequential damages

14. Prohibited Use Cases

You may not use the Services for:

  • Health-related decisions
  • Legal determinations
  • Credit or financial risk decisions
  • Any high-stakes or regulated decision-making

15. Governing Law

These Terms are governed by the laws of Ontario, Canada.

Disputes shall be resolved in the courts of Ontario.
